The Appellant is a trained medical doctor, married to PW 1. The Appellant was alleged to have defiled and sexually assaulted PW 2 (his wife’s niece, who was said to be underage at the time). The complaint was made to the Police who arrested and interrogated the Appellant. At the police station, the Appellant was said to have made confessional statement. The Appellant was subsequently
charged and arraigned on a-two-count charge of defilement and sexual assault by penetration contrary to Sections 137 and 261 of the Criminal Law, Chapter 17 Volume 3, Laws of Lagos State, 2025.
At the trial, the prosecution called six witnesses, including the prosecutrix, her aunt, investigating police officers, and medical doctor who conducted some tests on the prosecutrix. The Appellant gave evidence and called two other witnesses. At the conclusion of the trial, the court delivered its judgement, convicting the Appellant as charged.
